delegations of the two Governments, agreed to declare as follows:

关于印发《六安市城市规划区户外广告监督管理暂行规定》的通知

《六安市城市规划区户外广告监督管理暂行规定》已经2002年5月8日市政府第39次常务会议审议通过,现予印发,请认真贯彻执行。

六安市城市规划区户外广告监督管理暂行规定
第一条 为加强对我市城市规划区内户外广告的监督管理,有效规范户外广告的设置、发布行为,促进经济发展和文明城市建设,保护消费者的合法权益,根据《中华人民共和国广告法》、《中华人民共和国城市规划法》、《安徽省户外广告监督管理办法》、《安徽省城市市容和环境卫生管理暂行办法》及有关法律、法规、规章,结合我市实际,制定本规定。
第二条 凡在六安市城市规划区范围内从事户外广告活动的适用本规定。
本规定所称户外广告是指:
(一)利用街道、广场、机场、车站、码头等公共场所的建筑物或者空间设置的路牌、霓虹灯、电子显示牌、橱窗、护栏、灯箱、实物模型、条幅、气球等广告。
(二)利用车、船、飞机等交通工具设置、张贴的广告。
(三)利用影剧院、体育场(馆)、文化馆、展萆馆、宾馆、饭店、游乐场等公共建筑设置、张贴的广告。
(四)利用其他形式在户外设置、张贴的广告。
第三条 市工商行政管理部门是六安市城市规划区内户外广告的监督管理机关。规划、公安、交通、文化等部门,应当按照各自的职责,积极配合,共同做好户外广告的监督管理工作。
第四条 六安市城市规划区内户外广告的设置规划,由市规划行政主管部门会同工商、环保、交通、公安等部门提出方案,报市人民政府批准。
第五条 实施户外广告设置规划时,应支持公平竞争,禁止地域封锁和部门垄断。
第六条 六安市城市规划区内街道的户外广告设置,实行竟标拍卖,有偿使用。户外广告竟标拍卖的具体办法,由市建设行政主管部门负责制定,报经市政府同意后实施。
第七条 广告发布者在统一规划的区域设置户外广告,由市工商行政管理部门统一审批;广告发布者在统一规划区域以外设置、发布户外广告,须征得市规划、环保、公安等主管部门同意后,再报市工商行政管理部门审批。
设置大型户外广告或在城市建筑物、设施上悬挂、张贴宣传品的,必须征得市市容环境卫生行政主管部门同意后,再由市工商行政管理部门审批。
第八条 有下列情形之一的,不得设置户外广告:
(一) 利用交通安全设施、交通标志的;
(二) 影响市政公共设施、交通标志的;
(三) 妨碍生产或人民生活,损害市容市貌或建筑物形象的;
(四) 在国家机关、文物保护单位和风景名胜点的建筑控制地带;
(五) 市人民政府禁止设置的设施或区域。
第九条 办理户外广告登记,应当向市工商行政管理部门提出申请,填写《户外广告登记申请表》,并提交下列证明文件:
(一) 营业执照;
(二) 广告经营许可证;
(三) 广告合同;
(四) 场地使用证明及市政府有关部门准予设置户外广告的批准件;
(五) 涉及医疗、药品、保健食品、医疗器械、农药、兽药等特殊商品的户外广告和法律、法规规定应当进行审查的其他户外广告,应提供有关行政主管部门对广告内容的审查批准文件;
(六) 在允许设置烟草广告的场所发布烟草广告,应提供省级广告监督管理机关审查批准文件;
(七) 政府有关部门对发布非广告信息的批准文件。
第十条 户外广告登记申请,应当在广告发布三十日前提出,市工商行政管理部门在证明、文件齐全后予以受理,在七日内做出批准或不予批准的决定,并书面通知申请人。
经审查符合规定的,核发《户外广告登记证》,并由登记机关建立户外广告登记档案,同时填制登记卡交辖区工商所建立经济户口,实行跟踪管理。
第十一条 户外广告应当本着谁发布谁定期保洁和维护的原则。批准使用期满的户外广告,由发布者负责拆除。需要延长的,应当在批准使用期满前15日内向原审批、登记部门办理延期手续。
户外广告在设置和使用过程中,造成人员伤亡或财产损失的,由设置者负责。
第十二条 户外广告必须按批准的内容、形式、规格、地点、数量、时限设置,不得擅自改变。
第十三条 广告经营者在办理户外广告登记手续时,应缴纳广告监督审查费。广告监督审查费收费范围、标准按省物价局、财政厅皖价行费字[1997]182号文件规定执行。
第十四条 违反本规定第七条第一款、第十二条规定的,由市工商行政管理部门没收非法所得,处以1000元以上5000元以下罚款,并限期拆除。
第十五条 对擅自设置大型户外广告影响市容的,可由市市容环境卫生行政主管部门责令纠正、限期清理,并处1000—5000元罚款;对非法张贴宣传品影响市容的,可由市市容环境卫生行政主管部门处以警告或者罚款,并限期拆除。
第十六条 违反户外广告其他规定的,依照相关法律、法规和规章的规定进行处罚。
第十七条 本规定具体应用中的问题由市工商行政管理部门和建设行政主管部门共同负责解释。
第十八条 本规定自发布之日起施行。
